Terms and Conditions

The Licensor reserves the right to license the same Software to other individuals or entities under a different license agreement.

After accepting this license agreement, the Licensee is permitted to use the Software under the terms of this agreement for no more than thirty (30) days, and for evaluation purposes only, without payment to the Licensor. For this purpose, the Licensor provides a special free trial version of the Software that can be freely
downloaded.

If the Licensee wishes to use the software for more than thirty (30) days and/or for purposes other than evaluating the Software, the Licensee must purchase a single user license or a multi-user license from the Licensor. This license bears the name of the licensed person or entity and is not transferable to any other party. Pricing and availability is subject to change without prior notice. If a single user license was bought, the Licensee has the option of installing the Software on a single machine possibly used by one or more persons. Installing the Software on a network server is not permitted.

If a multi-user license was bought, the Licensee may choose to install the Software on as many machines as licenses were bought, but no more, or the Licensee may choose to install the Software on one or more network servers on the condition that the number of client machines that have access to that server or those servers, is equal to or less than the number of licenses bought. When the number of client machines grows, the Licensee must buy additional licenses.

Regardless of the number of licenses bought, the Licensee has right to place an additional copy of the Software and the license key on a removable medium for backup purposes to protect the investment made.

Technical support is available directly from the Licensor through ManshiRT yahoo group and various other forums at no additional charge. When encountering problems, the Licensee must first visit the help file, videos and readthe information presented there to make sure the question or problem is not already answered there. If not, the licensee may write to ManshiRT group or Suny_hyd2000@yahoo.com with his question in English language.

The Software is provided "as is". In no event shall the Licensor or any of the Licensor's affiliates be liable for any consequential, special, incidental, or indirect damages of any kind arising out of the delivery, performance or use of this Software, to the maximum extent permitted by applicable law. While the Software has been developed with great care, it is not possible to warrant that the Software is error free. The Software is not designed or intended to be used in any activity that may cause personal injury, death, or any other severe damage or loss. Neither shall the Licensee be liable for any consequential, special, incidental, or indirect damages of any kind arising out of the use of this Software under the terms of this License Agreement.

When errors are found in the Software, the Licensor will release a new version of the Software that no longer contains those errors a reasonable amount of time after the Licensor is given an accurate description of those errors. The amount of time considered reasonable will depend on the complexity and severity of the
errors. The Licensor will mention the release and if any, at the Licensor's option, directly contact the Licensee to announce the new release. The Licensee can then, at their option, upgrade to the latest version or to continue to use the older version the Licensee already has. In either case, no payment to the Licensor is required. In the latter case, the Licensee will no longer be entitled to technical support until the Licensee has upgraded to the latest version. Further the software has depedendency on external data sources like Yahoo, Google, Trade Tiger, TT Advance, Odin, Nest Trader, PIB, Keat Pro etc, any changes in the above sources which makes the software break and it is not feasible to fix, the Licensor will not be held responsible.

The Licensor reserves the right to charge an upgrade fee in the case of new enhancements or additions to the Software. This new version will then start a new version line which will use version numbers clearly distinguishable from the old version line. The Licensor does not have obligation to maintain older versions. Owing to depedency on external data sources, technical support will be provided on the newer versions only. In case the license is granted for a limited duration, the licensee needs to renew his license for further duration for a fee as applicable. The renew fee can be changed without notice.

The licensor does not provide data services unless specifically mentioned for specific packages but uses data from various sources like Yahoo, Google, Odin, Trade Tiger, TT Advance, PIB, Keatpro and free data provided by exchanges. The data from these sources is processesed, converted and fed to various charting software. use of data captured from trading terminals is purely the perogative of user and any misuse of captured data is the responsibility of user. Software creator/owner will not be responsible for any type of legal/illegal use of data whether it is captured form trading terminals or downloaded form internet. Further the Licensor can not be held responsible if there is any change in the above data providers which makes the software functionality break.

The Licensor is providing two types of licenses : Subcription based and one time payment based models. For subscription based model or license, the Licensor charges money for a duration e.g. monthly, half yearly, yearly etc. The Licensor will provide support for the subscription based model for whole of the subscription duration with new released for fixing the errors or new features.

In addition to subscription based model, the licesor is offering one time payment option for a few packages which are priced as considerable discount price to the subscription based model. For the one time payment option, the software with all the features applicable for the package subscribed as available on the date of release will be provided. There after, the Licensor will provide free upgrades for a period of one year wherever possible at intervals. Once subscribed, the user can get refund within 7 days after which refund will not be done. The Licensee is requested to use the evaluation version prior to purchasing the software to judge suitability of the software. The licensor will provide technical support for the first one month only for such packages and it is expected that the user has explored and gained enough expertize to use the software. Further one time payment option is entitled for one year of server based backfill. If the licensor wishes to continue using server based backfill the same can be subscribed to as per the rate applicable at that point of time.

The Licensor reserves the right to revoke the Licensee's license without prior notice if the Licensee violates any of the terms of this license agreement.

You must not attempt to reverse compile, modify, translate or disassemble the Software in whole or in part. You must not run the Software under a debugger or similar tool allowing you to inspect the inner workings of the Software.

You must not attempt to overload the servers.

The Software remains the exclusive property of the Licensor. Any Licensee which fully complies with the terms in this license agreement may use it according to the terms of this license agreement. You must not give copies of the Software or your license key to other persons or entities. You must not transfer the Software or your license key to another person or entity. You must also take reasonable steps to prevent any third party from copying the software from one of your machines without your permission.

You may distribute the evaluation version of the Software that is available for public download at the moment that you do distribute it, on the condition that you do this by making identical copies of the downloaded file(s). Public download means any file that can be downloaded and navigating through the links, without the use of any password or identification that you may type in or that may be automatically supplied by your browser if you have typed it in before.

You must not ask payment for the act of distributing the evaluation version of the Software or for the evaluation version itself. You must make it clear to the recipient that you are sending an evaluation version and that the recipient will have to accept a license agreement in order to evaluate it, and make payment in order to fully use the Software. You must not distribute the evaluation version by making it part of a larger package, unless that package is a collection of evaluation software and other software that does not require payment.

No Claims are made for the Accuracy Of Content, Data or Service. Speed Of Data Feed is Dependent On Many Conditions including Broadband speed, System Performance, Network Conditions and data delay at the data source itself. Products Contained use Data Available Freely On Net. RT/Real Time Data Is Only Product Name and doesnt reflect in any way on actual product. Any Data Provided is For Educational Purposes Only And Not For Actual Trading. We record your ip and other details to provide you with custom and prompt solutions including Support.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT AUTHOR AND PARTNERS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF RED SOFTWARE OR PARTNERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RESULTING FROM: (i) THE USE OR THE INABILITY TO USE RED SOFTWARE PRODUCTS; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM RED SOFTWARE PRODUCTS; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON RED SOFTWARE PRODUCTS; OR (v) ANY OTHER MATTER RELATING TO MANSHI REALTIME SOFTWARE PRODUCTS.

Legal jurisdiction, if any arises, will be done in a court located in Hyderabad India.
